  Chapter I General
The first one is to implement the "National Innovation Driven Development Strategy Outline", promote mass entrepreneurship and innovation, accelerate the industrialization of scientific and technological achievements, increase the precise support for small and medium-sized enterprises, strengthen the technology-based SME group, and cultivate a new economy. The growth point is formulated in accordance with the requirements of the Implementation Plan for Deepening the Reform of the Science and Technology System.
Article 2 The term "sci-tech SMEs" as mentioned in these Measures refers to SMEs that rely on a certain number of scientific and technological personnel to engage in scientific and technological research and development activities, obtain independent intellectual property rights and convert them into high-tech products or services, thereby achieving sustainable development. .
Article 3 The evaluation of scientific and technological small and medium-sized enterprises shall adopt the independent evaluation of enterprises, the organization and implementation of provincial-level scientific and technological management departments, and the service supervision of the Ministry of Science and Technology, and adhere to the principle of service leadership, integration, and transparency.
Article 4 The Ministry of Science and Technology is responsible for the construction of the “National Technology SMEs Information Service Platform” (hereinafter referred to as the “Service Platform”) and the “National Science and Technology SME Information Database” (hereinafter referred to as the “Information Library”). The Torch High Technology Industry Development Center of the Ministry of Science and Technology is responsible for the daily work of the service platform and information base construction and operation.
Enterprises may conduct independent evaluation according to these Measures, and report the enterprise information to the service platform according to the voluntary principle. If there is no objection to the publicity, it shall be included in the information base.
Article 5 All relevant departments and people's governments at all levels shall provide accurate support and precise services to the scientific and technological small and medium-sized enterprises that are included in the information base. The policies and measures formulated to support enterprise technological innovation shall give priority to supporting enterprises included in the information base.
Chapter II Evaluation Indicators
Article 6 SMEs must meet the following conditions at the same time:
(1) Resident enterprises registered in China (excluding Hong Kong, Macao and Taiwan).
(2) The total number of employees shall not exceed 500, the annual sales income shall not exceed 200 million yuan, and the total assets shall not exceed 200 million yuan.
(3) The products and services provided by the enterprise are not prohibited, restricted or eliminated by the state.
(IV) The enterprise did not report any major safety, major quality accidents, serious environmental violations, serious scientific research and untrustworthy behavior in the previous year and the current year, and the enterprise was not included in the list of abnormal business operations and the list of seriously illegal and untrustworthy enterprises.
(5) The score of the comprehensive evaluation of the enterprise based on the evaluation index of the SMEs shall not be less than 60 points, and the score of the scientific and technical personnel shall not be 0 points.
Article 7 The evaluation indicators for SMEs include science and technology personnel, R&D investment, and scientific and technological achievements, with a score of 100.
1. Scientific and technical personnel indicators (out of 20 points). According to the proportion of the number of scientific and technical personnel in the total number of employees, the evaluation of the file.
A. 30% or more (20 points)
B. 25% (inclusive) -30% (16 points)
C. 20% (inclusive) -25% (12 points)
D. 15% (inclusive) -20% (8 points)
E. 10% (inclusive) -15% (4 points)
F. 10% or less (0 points)
2. R&D investment indicators (out of 50 points). The enterprise selects one of the two indicators (1) and (2) for scoring.
(1) According to the ratio of the total R&D expenses of the enterprise to the total sales revenue.
A. 6% or more (50 points)
B. 5% (inclusive) - 6% (40 points)
C. 4% (inclusive) - 5% (30 points)
D. 3% (inclusive) - 4% (20 points)
E. 2% (inclusive) - 3% (10 points)
F. 2% or less (0 points)
(2) According to the ratio of total R&D expenses of enterprises to the total cost and expenses.
A. 30% or more (50 points)
B. 25% (inclusive) -30% (40 points)
C. 20% (inclusive) -25% (30 points)
D. 15% (inclusive) -20% (20 points)
E. 10% (inclusive) -15% (10 points)
F. 10% or less (0 points)
3. Indicators of scientific and technological achievements (out of 30 points). Evaluate according to the type and quantity of intellectual property rights (the intellectual property rights should be free of disputes or disputes) related to the main products (or services) owned by the company during the validity period.
A. 1 or more Class I intellectual property rights (30 points)
B. 4 or more Class II intellectual property rights (24 points)
C. 3 categories of II intellectual property (18 points)
D. 2 Class II intellectual property rights (12 points)
E. 1 category II intellectual property (6 points)
F. No intellectual property rights (0 points)
Article 8 An enterprise that meets the requirements of Items (1) to (4) of Article 6 may directly confirm the conditions for complying with the requirements of SMEs if it meets one of the following conditions:
(1) The enterprise has a high-tech enterprise qualification certificate within the valid period;
(2) The company has received national-level science and technology awards in the past five years and ranked among the top three winners;
(3) The enterprise has a recognized R&D institution at or above the provincial and ministerial level;
(4) The company has presided over the formulation of international standards, national standards or industry standards in the past five years.
Article 9 Description of evaluation indicators for small and medium-sized enterprises of science and technology:
(1) Enterprise science and technology personnel refers to the personnel directly engaged in R&D and related technological innovation activities, as well as those who specialize in the management of the above activities and provide direct services, including on-the-job, part-time and temporary hires. Part-time and temporary hires must be in the enterprise throughout the year. Accumulated work for more than 6 months.
(2) The total number of employees of the enterprise includes the on-the-job, part-time and temporary employment of the enterprise. The incumbent personnel are identified through whether the enterprise has signed a labor contract or paid social insurance premiums. Part-time and temporary employees must work in the enterprise for more than 6 months.
(3) The enterprise R&D expenses refer to the related expenses incurred in the R&D activities of the enterprise, which are specifically in accordance with the “Notice on Improving the Pre-tax Deduction Policy for Research and Development Expenses” by the Ministry of Science and Technology of the Ministry of Finance (Cai Shui [2015] No. 119) Provisions are made for collection.
(4) The sum of the sales revenue of the enterprise as the main business and other business income.
(5) Classification of intellectual property rights, including: invention patents, new plant varieties, national crop varieties, national new drugs, national first-class Chinese medicine protection varieties, exclusive rights for integrated circuit layout design according to Class I evaluation; utility model patents, Design patents and software copyrights are evaluated according to Class II.
(6) The establishment of international standards, national standards or industry standards by enterprises refers to the top five drafting units in the relevant documents of the National Standardization Committee, the Ministry of Industry and Information Technology, and the International Organization for Standardization.
(7) Research and development institutions at or above the provincial and ministerial level include national (provincial and ministry) key laboratories, national (provincial and ministry) engineering technology research centers, national (provincial and ministry) engineering laboratories, and national (provincial and ministry) engineering research centers. National (provincial, ministry) enterprise technology center, national (provincial, ministry) international joint research center.
Chapter III Information Filling and Registration
Article 10 An enterprise may independently evaluate whether it meets the requirements for SMEs in accordance with these Measures. If it meets the requirements, it may voluntarily register the basic information of the enterprise on the service platform and fill out the “Technical SME Information Sheet” (Annex) online.
The provincial-level science and technology management departments shall organize the relevant units to confirm whether the contents of the “Science and Technology SME Information Sheet” submitted by the enterprise are complete. If the content is incomplete, notify the company to make corrections on the service platform. The information is complete and qualified, and the provincial science and technology management department shall publicize the service platform for 10 working days.
Enterprises that have no objection to the publicity shall be included in the information base and announced on the service platform; if there is any objection, the provincial science and technology management department shall organize the relevant units to carry out verification and processing.
Article 11 The provincial-level science and technology management department shall assign the storage registration number (hereinafter referred to as the “registration number”) to the warehousing enterprise for the SMEs.
The relevant unit can check the registration number of the enterprise through the service platform.
Article 12 The warehousing enterprises shall update the information in the "Science and Technology SME Information Sheet" through the service platform before the end of March each year, and conduct independent evaluation on whether the enterprise still meets the requirements of the SMEs, and still meet the conditions. The procedures shall be handled by the provincial-level scientific and technological management department in accordance with the procedures stipulated in Articles 10 and 11 of these Measures.
Article 13 If a warehousing enterprise has undergone a major change or a major change related to the conditions stipulated in Chapter 2, the change shall be reported through the service platform within three months.
Article 14 If a warehousing enterprise has one of the following acts, the provincial science and technology management department shall revoke the annual registration number of its behavior and announce it on the service platform:
(1) The enterprise has undergone major changes and no longer meets the conditions stipulated in Chapter II;
(2) There are serious acts of fraud;
(3) Serious scientific untrustworthy behavior occurs;
(4) A major safety, major quality accident or serious environmental violation occurs;
(5) Being included in the list of business exceptions and the list of seriously illegal and untrustworthy enterprises;
(6) The information of the “Science and Technology SMEs Information Sheet” was not updated on schedule.
Article 15 The Ministry of Science and Technology shall supervise and inspect the management of provincial-level scientific and technological management departments according to the needs of work. The provincial-level science and technology management department shall conduct spot checks on the warehousing enterprises, and those that are not qualified by the spot check or audit enterprise shall be dealt with by the provincial-level science and technology management department in accordance with the provisions of Article 14.
Chapter IV Supplementary Provisions
Article 16 These Measures shall be interpreted by the Ministry of Science and Technology, the Ministry of Finance and the State Administration of Taxation.
The provincial science and technology management departments, financial departments and tax authorities may formulate implementation rules according to the local conditions.
Article 17 These Measures shall be implemented as of the date of promulgation.
